The National Electric Energy Agency (“ANEEL”) published Normative Resolutions No. 875 (“REN 875/20”) and No. 876 (“REN 876/20”), consolidating the rules related to the granting of electricity generation projects . The consolidation did not interfere with the merits of the standards, but only promoted, in short, the relocation and/or subtraction of devices and the improvement of their wording.

In total, REN 875/20 replaced 07 standards (REN 395/98; REN 343/08; REN 412/10; REN 672/15; REN 673/15; REN 680/15; and REN 765/17) and the REN 876/20 replaced 04 standards (REN 390/09; REN 391/09; REN 564/13; and REN 676/15).

Following consolidation, REN 875/20 becomes the only standard to provide for the requirements and procedures necessary for:

  • approval of hydroelectric inventory studies of river basins;
  • obtaining authorization to explore hydroelectric plants;
  • communication regarding the implementation of a hydroelectric generating plant with reduced installed capacity; It is
  • approval of technical and economic feasibility studies for a hydroelectric plant subject to the concession.

REN 876/20 becomes the only standard to provide for the requirements and procedures necessary for:

  • obtaining authorization to operate wind, photovoltaic, thermoelectric and other alternative sources;
  • change in the installed capacity of wind, photovoltaic, thermoelectric and other alternative sources; It is
  • communication of the implementation of generating plants with reduced installed capacity.

The consolidation also makes it possible to prepare the Generation Procedures (“PROGER”), an activity included in the Review of the Indicative Regulatory Agenda Cycle 2015-2016. PROGER will regulate the issuance and management of grants for all sources of electrical energy generation, segmented by source.

Although REN 673/15 and REN 395/98 (now revoked) are in the process of being reviewed by ANEEL, the consolidation promoted by REN 875/20 and REN 876/20 does not prevent the future implementation of these reviews. According to a vote by Director Rodrigo Limp Nascimento, the improvements identified at the close of public hearings may be consolidated in the new standards, obliging ANEEL to define procedures for the harmonious incorporation of possible changes.
